THIS UNCHARTED WORLD
Terms & conditions
The terms that apply when you book or join a This Uncharted World walking tour.
1. Who we are and what these terms cover
These Terms & Conditions form the agreement between you and Living Lettuce Limited (NZBN 9429052544378), trading as This Uncharted World ("we", "us", "our"), when you book or take part in any of our guided walking tours.
By making a booking — for yourself or for anyone else — you confirm that you have read these terms, that you accept them, and that you have authority to accept them on behalf of everyone in your booking.
Please also read our Refund & Cancellation Policy and our Privacy Policy. Together with your booking confirmation, they form the whole agreement between us.
2. Our tours
| Tour | Duration | Distance | Start | Finish |
|---|---|---|---|---|
| The Ultimate Christchurch Walking Tour | 3 hours | 5.5 km | Tūranga, Gloucester Street doors | Bridge of Remembrance, Cashel Street |
Full details of what is included and excluded for each tour are on the product page and in your booking confirmation. Where a listing on Viator, GetYourGuide or another sales channel describes a tour, that description forms part of what we have agreed to provide.
3. Booking and payment
- All prices are in New Zealand dollars and include GST. We operate rate parity: the same retail price applies on every channel.
- A booking is confirmed when you receive a written confirmation from us or from the platform you booked through. Availability is not held until then.
- Payment is taken in full at the time of booking unless we agree otherwise in writing.
- If you booked through Viator, GetYourGuide or another travel agent or platform, your payment, booking amendments and refunds are handled by that platform under their booking terms. Their cancellation terms apply to that booking, alongside these terms for the conduct of the tour itself. If their terms are more generous to you than ours, theirs apply.
- Children are priced 0–15; adults are 16 and over. Everyone taking part needs a ticket, including infants in prams and carriers.
4. Meeting us
- Your booking confirmation contains the exact meeting point, a map link and a contact phone number. Meeting points are specific — for the Ultimate tour it is the Gloucester Street doors of Tūranga, on the public footpath, not inside the building, not in Cathedral Square and not at the café.
- Please arrive 10 minutes before the departure time.
- Tours depart on time out of fairness to everyone who arrived. If you are late, we will do what we reasonably can to help you join the group — call the number on your confirmation — but we cannot hold the group, delay the tour or guarantee that you will be able to join. A missed departure is treated as a no-show (see the Refund & Cancellation Policy).
5. Fitness, accessibility and suitability
We want you to have an accurate picture before you book. Please read this section properly.
- The Ultimate Christchurch Walking Tour covers 5.5 km over 3 hours. The route is flat and sealed throughout the central city, with one short cobbled section at the Arts Centre. Three seated breaks are built in, at roughly 45, 85 and 105 minutes. It is not suitable for anyone who is not comfortable walking 5.5 km over three hours.
- Toilets are available at the start and at points along the route. These are listed on the product page.
- Prams and carriers are welcome on our walking tours.
- Please tell us at the time of booking about any medical condition, mobility need, allergy or dietary requirement that could affect your participation or that a guide may need to know about in an emergency. We treat this information confidentially and only use it to run the tour safely — see our Privacy Policy.
- Children under 16 must be accompanied by a responsible adult at all times, and that adult remains responsible for supervising them for the whole tour.
- We will do what we reasonably can to accommodate accessibility requirements. Please contact us before booking so we can tell you honestly whether a tour will work for you.
6. Safety — your part in it
Our tours take place on public streets in a working city. You will cross roads with live traffic, tram corridors and cycleways.
- You must follow the guide's safety instructions at all times. This is not only a condition of your booking — under section 46 of the Health and Safety at Work Act 2015 it is a legal duty owed by every person at a workplace to take reasonable care for their own safety and the safety of others, and to follow reasonable instructions.
- Your guide will give a safety briefing at the start of every tour. Please listen to it. New Zealand drives on the left — when you cross a road, look right first.
- Please wear comfortable, closed, flat walking shoes, and bring sun protection and water in summer. New Zealand's UV levels are among the highest in the world.
- Tell your guide immediately if you feel unwell, need to stop or need to leave. You may leave the tour at any point — just tell the guide first so we know you are safe.
- We may end your participation in a tour without a refund if you are intoxicated, behave aggressively or unlawfully, repeatedly refuse safety instructions, or put yourself or anyone else at risk. We will do this as considerately as the situation allows.
- Your guide may modify, shorten, shelter or end a tour at any time on safety grounds. Guides have our full authority to make that call without checking with anyone. If they do, the Refund & Cancellation Policy applies.
7. Changes we may make
- We may change the route, the order of stops or a venue where it is necessary for safety, because of weather, roadworks, a closure, an event or something outside our control. We will keep the substance of the tour intact and tell you as early as we can.
- Third-party venues occasionally close without notice. If an included food or drink stop is unavailable, we will substitute something comparable or refund the value of that inclusion.
- Access to buildings, gardens and public spaces is controlled by their owners and may change. Our tours view the exteriors of buildings unless the listing says otherwise, and admission fees are not included unless stated.
8. Photography
- We may take photographs or video on tours for our own marketing. Tell your guide if you would prefer not to appear and we will make sure you do not. You can also ask us afterwards to remove an image of you — see our Privacy Policy.
- You are welcome to take your own photographs. Please be considerate of other guests, of the public and of the places we visit, and do not stop in a cycleway or on a tram corridor to do it.
9. Your rights under New Zealand consumer law
- If you are a consumer, the Consumer Guarantees Act 1993 gives you guarantees that our services will be provided with reasonable care and skill, will be fit for the purpose you told us about, and will be completed within a reasonable time. Nothing in these terms limits or excludes those guarantees, and we cannot contract out of them.
- The Fair Trading Act 1986 requires us not to mislead you. If anything on our website, in a listing or in these terms is unclear or looks wrong, please tell us and we will fix it.
- Where you are acquiring our services for the purposes of a business, and both parties are in trade, the consumer guarantees do not apply to the extent permitted by section 43 of the Consumer Guarantees Act.
10. Liability
We want to be straightforward about this rather than hide behind a wall of exclusions.
- We take our health and safety obligations seriously. We operate under a documented Health & Safety Policy and a written risk assessment for every route, as required by the Health and Safety at Work Act 2015. We do not ask you to sign away our safety duties, and we could not do so if we wanted to — section 28 of that Act makes any such term ineffective.
- Personal injury in New Zealand is covered by ACC. New Zealand's Accident Compensation scheme provides no-fault cover for personal injury by accident, including for overseas visitors. In return, section 317 of the Accident Compensation Act 2001 bars proceedings for compensatory damages for injury covered by the scheme. This applies regardless of anything in these terms.
- ACC does not replace travel insurance, and we strongly recommend you have it. ACC does not cover illness, loss of earnings in your home country, repatriation, cancelled travel, missed connections or lost belongings. If you are visiting New Zealand, please travel insured.
- Subject to your rights under the Consumer Guarantees Act and to paragraphs 1 and 2 above, we are not liable for indirect or consequential loss, and our liability for any other loss is limited to the amount you paid for the tour.
- We are not liable for missed onward transport connections where the delay is outside our reasonable control. If a delay is our fault we will do what we reasonably can to put it right — see the Refund & Cancellation Policy.
- You are responsible for your own belongings. Please do not leave anything with the guide.
11. Cancellations and refunds
Set out in full in our Refund & Cancellation Policy, which forms part of these terms. In short:
- Free cancellation more than 24 hours before your tour, for a full refund.
- Full refund if we cancel, for any reason, including weather and safety.
- Bookings made through Viator, GetYourGuide or another platform are cancelled through that platform under its terms.
12. If something goes wrong
Please tell your guide at the time if you can — most things can be put right on the spot. Otherwise contact us at hello@thisunchartedworld.com and we will respond within 7 working days.
If we cannot resolve it between us, you may take the matter to the Disputes Tribunal, or contact Consumer Protection at consumerprotection.govt.nz.
13. Privacy
We collect and handle personal information in accordance with the Privacy Act 2020 and our Privacy Policy, which explains what we collect, why, who we share it with and how you can access or correct it.
14. Force majeure
We are not liable for failure to provide a tour where that failure is caused by something outside our reasonable control — including earthquake, severe weather, fire, flood, pandemic, government restriction, civil emergency, strike, a Police cordon or the closure of a public space. In those circumstances the Refund & Cancellation Policy applies, and you will not be left out of pocket for a tour you did not receive.
15. General
- These terms are governed by New Zealand law and the New Zealand courts have jurisdiction.
- If any part of these terms is found to be unenforceable, the rest continues to apply.
- We may update these terms. The version that applies to your booking is the one published when you booked, and we will keep previous versions available on request.
- Intellectual property. Our route guides, printed materials, tour content, website and listing copy remain our property. You are welcome to enjoy and share your own photographs; please do not reproduce our written materials commercially.
